Next, there is a report on Li Qiang’s speech (full English text) at Summer Davos in Dalian. This was a well-constructed speech and it hit the right notes from Beijing’s perspective. It highlighted China’s advantages and priorities when it comes to technology and innovation; it was political without being confrontational; there was a clear pitch to international corporations and the larger developing world, positioning China as the leader in open-source AI; and it did well to position Beijing as a responsible global actor in governance of emerging technologies. It would be great to hear how it landed with the audience and what the vibes were in Dalian.
Anyway, here are excerpts:
The first part of the speech has Li talking about the four keywords for China’s economy in 2026. These are: stability, innovation, dynamism, and integration.
“Stability may not seem much on an ordinary day. But, when China’s economy, at a massive volume of RMB140 trillion yuan, continues to register steady and healthy growth despite the shocks of global energy shortages and severe supply-chain disruptions, when it continues to bring much needed certainty to this increasingly uncertain world and plays a vital role as a safe harbor, such solid and robust stability is all the more precious.”
“In the first half of the year, multiple types of commercial rockets have been successfully launched, and technologies such as quantum information, integrated circuits, and nuclear fusion have been advancing at an accelerated pace. Most notably, the artificial intelligence sector has seen explosive growth. Several major AI models have reached new milestones in performance, daily token usage has hit several hundred trillion and ranked first in the world by the end of May, and embodied intelligence has moved into large-scale commercial application.”
“At a time of rising unilateralism and protectionism, China remains as committed as ever to opening up further. We have extended zero-tariff policies to 63 countries, stayed as the world’s second-largest import market for 17 years running, and recorded an import growth of 20.5 percent in the first five months of this year, significantly higher than export growth…For China, integrated development with the world has never been an expediency, but a strategic decision made in line with the trend of history and based on our own development philosophy.”
Li then talked about China’s focus on innovation-driven development:
“During the 14th Five-Year Plan period from 2021 to 2025, our total R&D expenditure grew by an average of 10 percent annually, making China the world’s second-largest R&D spender. Last year, basic research accounted for more than seven percent of total R&D expenditure, setting a new historical record for China. It is the same with Chinese enterprises, who have demonstrated unyielding resilience and steadfast dedication. Many industry leaders have endured operational pressures brought about by prolonged and costly R&D commitments. Some incurred heavy losses at certain stages, and others faced unfair external suppression. Yet none of them ever wavered in their commitment, and their perseverance has finally paid off. During the 15th Five-Year Plan period, we will further strengthen research on key technologies, significantly raise the proportion of basic research funding, and continuously enhance the capacity for original innovation. All this will provide an inexhaustible source of energy for the innovation-driven and high-quality development of China’s economy.”
He added that the goal is “better connecting science and technology with industry. After years of pursuing innovation-driven development, China has blazed a successful path whereby sci-tech innovation spearheads industrial innovation and industrial upgrade propels sci-tech evolution…In recent years, we have made active explorations in frontier and emerging sectors, and achieved a large volume of innovation outcomes that have given birth to many new industries. The vigorous growth of China’s new energy and intelligent connected vehicle industries, for example, has been enabled by sci-tech breakthroughs in new materials, power batteries and communications technology. These innovations are the core competitiveness of Chinese products, not government subsidies as some have speculated. We cannot afford to give so many subsidies.”
“China’s innovation has been nurtured in an enabling environment. Innovation today is highly complex and systemic, requiring larger-scale resources input, stronger supporting measures, and a more enabling institutional environment. For years, China has worked hard to enhance its systemic innovation capacity and achieved remarkable results. We have been increasing support in resources and factors of production, putting in place a diversified investment system with enterprises leading the way, government providing guidance and society participating, building a batch of major sci-tech research facilities and infrastructure, and training some seven million university graduates in science, engineering, agriculture and medicine every year. We have prioritized building innovation platforms. Of the world’s top 100 innovation clusters, 24 are in China, ranking first in the world for three consecutive years. Professional, differentiated and specialized industrial clusters spread across the country, from the one-hour electronic information innovation circle in the Yangtze River Delta, the one-hour motorcycle industrial circle in Chongqing, to the 30-minute supporting circle in Shenzhen’s Robot Valley. These platforms have incubated a large number of high-tech enterprises as well as ‘little giants’ that use specialized and sophisticated technologies to produce novel and unique products. Moreover, we have deepened reforms of systems and institutions, introducing a series of new policies and new measures in intellectual property rights protection, risk sharing, innovation incentives, etc. Going forward, we will continue to improve the innovation-friendly ecosystem and speed up the development of infrastructure including new-type power grids, computing power networks and new-generation telecommunication networks, so as to effectively remove barriers to better resource allocation and keep unlocking and unleashing the innovation dynamism of the whole society.”
Li then sought to counter the China Shock 2.0 narrative by pitching the China Opportunity 2.0 narrative.
“In the past, China’s big market and low-cost production factors provided ‘market dividends’ for the world. Today, while continuing to provide even greater ‘market dividends’, China is also offering more and more ‘innovation dividends’ with its technological progress and industrial upgrading. What these combined dividends generate for the world are greater opportunities and potential of development. For enterprises around the world, ‘China opportunity 2.0’ means across-the-board innovation empowerment and high-return investment opportunities.”
Apart from the benefits that this brings for foreign companies, Li also talked about how this opportunity benefits the developing world too:
“For global development, ‘China opportunity 2.0’ means more accessible advanced technologies and widely shared outcomes. China is committed to an open approach to innovation. Much of its innovation is open-source. This enables more countries, particularly developing countries, to access affordable new technologies and new products, which has enhanced their development capacity and can help address many difficulties holding back global development. Today, China’s large open-source AI models have been downloaded by over 10 billion times globally in cumulative terms, large-scale scientific facilities in controlled nuclear fusion, quantum technology and other areas are open to the world, and the Tiangong space station is set to welcome foreign astronauts. These are proof enough that what China’s technologies and products in emerging areas bring to the world are not shocks or threats, but opportunities and empowerment.”
In the final part of the speech, Li talks about the future of innovation. This is how he describes the state of affairs:
“First, never before has technology advanced so fast, but the risk of uncontrollability is notably rising. AI has vastly enhanced innovation efficiency, with breakthroughs emerging on all frontiers. Some call this the ‘Cambrian moment’ of the intelligent age, but the risks of losing control and ethical lapses are also mounting. Without commensurate governance, the fallout could be severe.”
“Second, never before has innovation been so deeply interconnected, yet the barriers to collaboration are increasing. Collective efforts that cross disciplines and national borders have become the mainstream and necessity of innovation. Yet technological walls, barriers and blockades are also growing more pervasive.”
What he proposes is:
“We should deepen connectivity and collaboration to build greater synergy for innovation. In this new round of technological revolution and industrial transformation, no country or company can succeed alone. An interconnected global market enables more efficient flow and allocation of production factors, and significantly reduces innovation costs. An inclusive and collaborative innovation network allows ideas to interact and converge more freely, accelerating breakthroughs in frontier technologies.”
“We should harness technology for good and be more effective in advancing collective governance. Innovation drives humanity’s quest for a better life. Advanced technologies should serve as tools that benefit people across countries, rather than sources of chaos that undermine peace and stability. This calls for better coordination between development and security, and a joint effort to improve global governance, so that technological progress always reflects humanity’s common values and advances global peace and development.”
While on this, on Page 2, there’s a report on Li’s engagement with business executives. That report says:
“After listening to the remarks of the business community representatives in attendance, Li Qiang pointed out that in recent years, the international community has increasingly recognized that there are no winners in trade wars and tariff wars, and that more and more countries are more actively advancing economic and trade exchanges, returning to the right path of mutual benefit and win-win cooperation. This fully reflects that openness and cooperation are an irreversible trend of the times, and are also the intrinsic need of all countries to expand their development space. No matter how the external environment changes, China will always follow the great historical trend of openness and cooperation, and will continue to participate deeply in international trade, investment, and other cooperation, promoting the connection and integration of the Chinese market with the world market.”
“The high-quality products exported by China constitute an important contribution to the world economy and help improve the economic efficiency and welfare of residents in importing countries. We have never deliberately pursued a trade surplus. China has always shared its domestic market with the world and is willing to import more high-quality products from all countries. Together with all parties, we are willing to promote optimized, balanced trade development by enlarging the overall ‘trade pie’. China’s industrial competitiveness has not been created through subsidies; rather, it stems from the combined advantages of its complete industrial system, ultra-large-scale market, and sound innovation ecosystem, as well as from the long-term, unremitting efforts and investment of enterprises. China’s industrial subsidies strictly comply with WTO rules; they are fair and broadly beneficial, and China treats domestic and foreign-invested enterprises equally. He expressed the hope that the entrepreneurs present would convey more rational voices to the international community and inject more positive energy into global economic and trade cooperation.”

Li Qiang stated that in recent years China’s economy has been developing toward the new and toward the better, which will bring more new opportunities to enterprises from all countries. The renewal and upgrading of the Chinese market will create more abundant incremental space, especially the diversified expansion of demand levels on top of an enormous scale, which is a precious opportunity that enterprises of all countries should not miss. The renewal and upgrading of Chinese manufacturing will create a more efficient industrial ecosystem, providing customized implementation solutions for the new products of enterprises from all countries and helping them rapidly raise their level of development. The renewal and upgrading of China’s infrastructure will provide more favourable overall conditions; through the digital and intelligent upgrading of traditional infrastructure and the networked deployment of new infrastructure, China will help enterprises from all countries gain a leading position in innovative development while also providing abundant investment opportunities.

Li Qiang stated that the Chinese government will do everything in its power to provide good service for enterprises of all countries, and to create a more open, fair, and friendly environment. Next, there’s a report on Zhao Leji telling NPC deputies that they should thoroughly study, publicize, and implement Xi Jinping Thought on Rule of Law. Xinhua summarises this well:
“China has implemented eight nationwide five-year initiatives to raise public awareness of the rule of law, which have resulted in stronger public awareness of the rule of law and greatly advanced law-based social governance, Zhao said. He urged NPC deputies to firmly establish a strong sense of the rule of law, and strengthen their awareness and capacity to fulfill duties, carry out work and resolve disputes in accordance with the law. They should step up the study of the Constitution, strictly follow legal procedures in performing duties, set an example in abiding by the Constitution and laws in work and daily life, and voluntarily accept oversight from the people, Zhao said. He called on NPC deputies to actively explore effective approaches for legal publicity and education, and earnestly hear and convey public opinions and suggestions regarding legislation and law implementation.”
Finally, there’s a report on Wang Huning’s remarks while addressing the closing meeting of a standing committee session of the CPPCC National Committee. Xinhua reports:
Wang “called on political advisors to rally public support, build consensus, pool wisdom, and gather strength for promoting high-quality development and advancing Chinese modernization. Noting that the 15th Five-Year Plan period marks a crucial stage in the journey toward the basic realization of socialist modernization, Wang urged the CPPCC to keep a firm hold on the theme and top priority of promoting high-quality development, remain committed to facilitating high-quality development through high-standard performance of its functions, and contribute to sustained, sound economic growth and all-round social progress. Political advisors should focus on major issues such as building a modern industrial system, achieving greater self-reliance and strength in science and technology, fostering a new development pattern, establishing a high-standard socialist market economy, ensuring and improving people’s livelihoods, and accelerating the comprehensive transformation towards green economic and social development, Wang said. “Wang Yi pointed out that three priorities should be addressed in the next stage.
First, consolidate the situation of a comprehensive ceasefire and cessation of hostilities; the flames of war must never be reignited. The Iran-US MoU is in line with Iran’s fundamental and long-term interests, and also conforms to the common expectations of the international community. The Chinese side is willing to work together with all parties to firmly support the negotiations in eliminating interference and advancing forward.
Second, normal navigation through the Strait of Hormuz should be restored as soon as possible to ensure the stability of global industrial and supply chains. The arrangements concerning the strait should respect the sovereignty and legitimate rights and interests of states bordering the strait, while conforming to international practices and the common aspirations of all countries.
Third, efforts should be made to support Middle East countries in improving their relations and exploring a new regional security architecture. The Middle East, including the Gulf region, should no longer serve as an arena for great power competition or a victim of geopolitics, and regional countries should uphold genuine strategic autonomy and firmly keep their future in their own hands.
Wang Yi added that the crux of the Middle East issue remains the Palestinian question. Page 6: There’s a report informing that in May, a total of 24,513 cases involving violations of the spirit of the Central Eight-Point Regulations were investigated and handled nationwide. A total of 31,184 people were involved, including 1 provincial- and ministerial-level cadre and 118 department- and bureau-level cadres. 20,012 people received Party disciplinary or administrative sanctions.
Finally, although it is not in the paper today, yesterday the Ministry of Commerce put out two interesting announcements. The first was the publication of the Measures for Industrial Chain and Supply Chain Security Investigation Work. These are issued “in order to implement the Regulations of the State Council on the Security of Industrial Chains and Supply Chains (State Council Decree No. 834), properly carry out work relating to security investigations of industrial chains and supply chains, and safeguard the security of China’s industrial chains and supply chains…”
I am sharing the full text below, with my notes on specific articles.
Article 1: For the purpose of carrying out security investigation work on industrial chains and supply chains, preventing security risks to industrial chains and supply chains, and enhancing the resilience and security level of industrial chains and supply chains, these Measures are formulated in accordance with the provisions of the National Security Law of the People’s Republic of China, the Foreign Relations Law of the People’s Republic of China, the Anti-Foreign Sanctions Law of the People’s Republic of China, the Foreign Trade Law of the People’s Republic of China, as well as the State Council Provisions on the Security of Industrial Chains and Supply Chains, and other relevant provisions. 第一条 为了开展产业链供应链安全调查工作,防范产业链供应链安全风险,提升产业链供应链韧性和安全水平,根据《中华人民共和国国家安全法》、《中华人民共和国对外关系法》、《中华人民共和国反外国制裁法》、《中华人民共和国对外贸易法》,以及《国务院关于产业链供应链安全的规定》等规定,制定本办法.
Article 2: The Ministry of Commerce shall be responsible for industrial chain and supply chain security investigation work and shall carry out investigative activities. 第二条 商务部负责产业链供应链安全调查工作,开展调查活动.
Article 3: The Ministry of Commerce may conduct an industrial chain and supply chain security investigation into measures or actions under any of the following circumstances:
(1) Where a foreign state, region, or international organization, in violation of international law and the basic norms governing international relations, adopts discriminatory prohibitive measures, restrictive measures, or other similar measures against our country in the area of industrial chains and supply chains, or carries out or assists in carrying out acts that harm the security of our country’s industrial chains and supply chains;
(2) Where a foreign organization or individual, in violation of the principles of normal market transactions, interrupts normal transactions with citizens or organizations of our country, adopts discriminatory measures against citizens or organizations of our country, or carries out other acts, thereby causing substantial harm or creating a threat of substantial harm to the security of our country’s industrial chains and supply chains. 第三条 商务部可以对以下情形的措施或者行为开展产业链供应链安全调查: (一)外国国家、地区和国际组织违反国际法和国际关系基本准则,在产业链供应链方面对我国采取歧视性禁止、限制或者其他类似措施,实施或者协助实施损害我国产业链供应链安全的行为; (二)外国组织、个人违反正常的市场交易原则,中断与我国公民、组织的正常交易,对我国公民、组织采取歧视性措施或者实施其他行为,对我国产业链供应链安全造成实质损害或者产生实质损害威胁.
(My note: This is incredibly broad and vague. It is essentially a political statement. The language around the violation of “international law and the basic norms governing international relations” and the mention of “region” have significance in the context of Taiwan. This potentially can be used as a lever to restrict countries and international organisations’ economic relations with Taiwan. The targeting of a “foreign state, region, or international organization” that “assists in carrying out acts that harm the security of our country’s industrial chains and supply chains” makes this extremely challenging for countries that might be complying with, say, American sanctions. This could also apply to a plurilateral arrangement that Beijing deems aimed at constraining its supply chains. The second part of the targets is even broader and much more vague. In fact, one can read it as a blanket clause in which one does not need to even demonstrate harm caused. Even the “threat of substantial harm” as deemed by the Ministry is something that can prompt action.)
Article 4: When the Ministry of Commerce assesses harm to the security of industrial chains and supply chains, it may consider the following situations:
(1) The impact of the relevant measures or actions on the security of the domestic and overseas factors related to our country’s industrial chains and supply chains, including important materials, technology, funds, assets, data, information, personnel, enterprises, projects, and so on;
(2) The impact of the relevant measures or actions on the smooth flow of the domestic and overseas factors related to our country’s industrial chains and supply chains, including the flow of logistics, the flow of commerce, the flow of people, the flow of funds, the flow of data, the flow of information, and so on;
(3) The impact of the relevant measures or actions on such aspects as the international competitiveness and development potential of our country’s industrial chains and supply chains;
(4) Other situations that affect the security of industrial chains and supply chains. 第四条 商务部在评估产业链供应链安全损害时,可以考虑以下情况: (一)有关措施或者行为对我国产业链供应链相关境内外要素安全的影响,包括重要物质、技术、资金、资产、数据、信息、人员、企业、项目等; (二)有关措施或者行为对我国产业链供应链相关境内外要素畅通流动的影响,包括物流、商流、人流、资金流、数据流、信息流等; (三)有关措施或者行为对我国产业链供应链国际竞争力和发展潜力等方面的影响; (四)其他影响产业链供应链安全的情况.
(My note: The third point here is quite something! When assessing harm, the Ministry really has carte blanche, particularly since the language says that this may include harm to China’s “international competitiveness and development potential.” This is an incredibly subjective assessment.)
Article 5: Where relevant domestic legal persons, organizations, and the like consider that the relevant measures or actions of a foreign state, region, organization, individual, or international organization harm or may harm the security of our country’s industrial chains and supply chains, and that it is necessary to initiate an industrial chain and supply chain security investigation, they may submit written materials such as evidence and reports to the Ministry of Commerce. 第五条 国内有关法人、组织等,认为外国国家、地区、组织、个人或者国际组织的有关措施或者行为,损害或者可能损害我国产业链供应链安全,需要启动产业链供应链安全调查的,可以向商务部提交证据、报告等书面材料.
(My note: This is the whistleblower clause. There’s no real clarity on what the burden of proof must be and what the timeline has to be for such evidence and assessment of risk, etc. The framing of this as demand- or enterprise-driven also can help shape narrative that this isn’t state action-based on political intent. This is not to argue that there might not be legitimate grievances that Chinese companies might have. But if you read the articles preceding this, it is clear that this is operationalising political intent in an era of coercive economic statecraft becoming the norm.)
Article 6: Relevant domestic legal persons, organizations, and the like may, through the competent commerce departments of provinces, autonomous regions, municipalities directly under the Central Government and cities specifically designated in the state plan, and the XPCC, forward relevant written materials such as evidence and reports to the Ministry of Commerce. 第六条 国内有关法人、组织等可以通过省、自治区、直辖市及计划单列市、新疆生产建设兵团商务主管部门,向商务部转交有关证据、报告等书面材料.
Article 7: The Ministry of Commerce may, in accordance with the actual situation, decide to place the matter on file and issue an announcement of case initiation. 第七条 商务部可以根据实际情况,决定立案并发布立案公告.
Article 8: The Ministry of Commerce may conduct the investigation by such methods as questioning the object of investigation and other relevant parties concerned, consulting or copying relevant documents and materials, publicly soliciting leads, distributing questionnaires, conducting sample surveys, carrying out technical appraisal, convening hearings, and conducting on-site investigation; the relevant parties concerned shall cooperate. In the course of the investigation, the Ministry of Commerce may collect relevant information on its own initiative. 第八条 商务部可以采用询问被调查对象等有关当事人、查阅或者复制相关文件及资料、公开征集线索、发放问卷、抽样调查、技术鉴定、召开听证会、实地调查等方式进行调查,有关当事人应当予以配合。商务部在调查中,可以主动收集相关信息. (Note: There’s no timeline given for this process. So this can be a case of the process being punishment.)
Article 9: When the Ministry of Commerce deems it necessary, it may establish an expert advisory group, responsible for providing advisory opinions on the technical and legal questions involved in the investigation. Members of the expert advisory group shall properly safeguard the classified materials, information, and the like relating to the investigation, and shall bear the corresponding confidentiality responsibility. 第九条 商务部认为必要时,可以成立专家咨询组,负责对调查中涉及的技术性和法律性问题提供咨询意见。专家咨询组成员应妥善保管调查相关涉密资料、信息等,承担相应保密责任.
Article 10: When the Ministry of Commerce deems it necessary, it may go to the relevant country or region to conduct an on-site investigation, except where the relevant country or region raises an objection. 第十条 商务部认为必要时,可以赴相关国家、地区进行实地调查。有关国家、地区提出异议的除外.
Article 11: The object of investigation and other relevant parties concerned may, during the investigation period, make statements and present defenses before the Ministry of Commerce. The Ministry of Commerce may require the relevant parties to submit or supplement written materials. Relevant parties may also voluntarily submit written materials. 第十一条 被调查对象等有关当事人可以在调查期间向商务部进行陈述、申辩。商务部可以要求有关当事人提交或者补充书面材料。有关当事人也可以主动提交书面材料.
Article 12: Where the object of investigation does not cooperate with the investigation, fails to truthfully report the circumstances and provide relevant materials within a reasonable time limit, or seriously obstructs the investigation by other means, the Ministry of Commerce may make a determination on the basis of the facts and information already obtained. 第十二条 被调查对象不配合调查,未在合理期限内如实反映情况、提供有关材料的,或者以其他方式严重妨碍调查的,商务部可依据已获得的事实和信息作出认定.
Article 13: In the course of the investigation, the Ministry of Commerce may carry out external consultations regarding the measures or conduct under investigation. 第十三条 商务部在调查过程中,可以就被调查的措施或者行为开展对外磋商.
Article 14: When the Ministry of Commerce deems it necessary, it may suspend the investigation. 第十四条 商务部认为必要时可以中止调查.
Article 15: Where one of the following situations arises, the Ministry of Commerce may terminate the investigation and issue an announcement:
(1) The country, region, organization, individual, or international organization under investigation has already canceled or adjusted the measures or actions under investigation, and has stopped the harm or threat of harm to the security of our country’s industrial chains and supply chains;
(2) The country, region, organization, individual, or international organization under investigation has already reached a resolution with our country;
(3) Other situations in which the Ministry of Commerce considers that the investigation may be terminated. 第十五条 出现以下情形之一的,商务部可以终止调查并发布公告: (一)被调查的国家、地区、组织、个人或者国际组织已经取消或者调整被调查的措施或者行为,停止对我国产业链供应链安全的损害或者损害威胁; (二)被调查的国家、地区、组织、个人或者国际组织已经与我国达成解决方案; (三)商务部认为可以终止调查的其他情形.
Article 16: Through the investigation, the Ministry of Commerce shall make a determination regarding the harm caused by the measures or actions under investigation to the security of our country’s industrial chains and supply chains, and issue an announcement. 第十六条 商务部通过调查,就被调查的措施或者行为对我国产业链供应链安全的损害作出认定,并发布公告.
Article 17: Based on the results of the investigation, the Ministry of Commerce may, together with the relevant departments and in accordance with procedures, adopt the following measures against states, regions, and international organizations that implement or assist in implementing acts harming the security of our country’s industrial chains and supply chains:
(1) Prohibit or restrict the import and export of goods or technology, or international trade in services, related to them;
(2) Levy special fees on activities related to them;
(3) In accordance with the Anti-Foreign Sanctions Law of the People’s Republic of China, the Provisions on Implementing the Anti-Foreign Sanctions Law of the People’s Republic of China, and other relevant provisions, place organizations and individuals that directly or indirectly participate in formulating, deciding upon, or implementing the measures or acts prescribed in Item (1) of Article 3 of these Measures on the countermeasure list, and adopt countermeasures against them;
(4) Other necessary measures. 第十七条 根据调查结果,商务部可以会同有关部门按程序对实施或者协助实施损害我国产业链供应链安全行为的国家、地区和国际组织采取以下措施: (一)禁止或者限制与其有关的货物、技术进出口或者国际服务贸易; (二)对与其有关的活动收取特别费用; (三)依照《中华人民共和国反外国制裁法》、《实施〈中华人民共和国反外国制裁法〉的规定》等,将直接或者间接参与制定、决定、实施本办法第三条第一项规定的措施或者行为的组织、个人列入反制清单,采取反制措施; (四)其他必要的措施.
(My note: The third point is significant because the scope of individuals or entities that can be covered need not be directly involved in any of the issues. Even organizations and individuals deemed as indirectly indirectly “formulating, deciding upon, or implementing the measures” can be targeted. How does one indirectly decide or formulate a measure of a nature that hurts China’s supply chains? That net could include an incredibly vast array of people.)
Article 18: On the basis of the investigation results, the Ministry of Commerce may, together with the relevant departments, adopt the following measures against foreign organizations and individuals that harm the security of our country’s industrial chains and supply chains:
(1) Prohibit or restrict their engagement in import and export activities related to our country;
(2) Prohibit or restrict their investment within the territory of our country;
(3) Prohibit or restrict organizations and individuals within the territory of our country from carrying out relevant transactions, cooperation, and other activities with them;
(4) Prohibit or restrict the entry into the country of relevant personnel, means of transportation, and the like;
(5) Revoke or restrict the qualifications of relevant personnel to work, stay, or reside within the territory of our country;
(6) Other necessary measures.
The above measures may be applied to organizations that are actually controlled by, or in the establishment or operation of which the foreign organizations or individuals participate. 第十八条 根据调查结果,商务部可以会同有关部门对损害我国产业链供应链安全的外国组织、个人采取以下措施: (一)禁止或者限制其从事与我国有关的进出口活动; (二)禁止或者限制其在我国境内投资; (三)禁止或者限制我国境内的组织、个人与其进行有关交易、合作等活动; (四)禁止或者限制相关人员、交通运输工具等入境; (五)取消或者限制相关人员在我国境内工作、停留或者居留资格; (六)其他必要的措施。 上述措施可以适用于外国组织、个人实际控制或者参与设立、运营的组织.
Article 19: Where an organization or individual within our country fails to implement the measures adopted by the Ministry of Commerce in accordance with the provisions of Articles 17 and 18 of these Measures, the Ministry of Commerce may order correction and, together with the relevant departments, adopt the following measures as appropriate to the circumstances:
(1) Prohibit or restrict them from engaging in such activities as government procurement, bidding and tendering, and related import and export of goods or technology, or international trade in services;
(2) Prohibit or restrict them from receiving data or personal information from abroad, or providing data or personal information to abroad;
(3) Prohibit or restrict them from leaving the country, or from staying or residing within our country;
(4) Other necessary measures. 第十九条 我国境内的组织、个人不执行商务部依照本办法第十七条、第十八条规定采取的措施,商务部可以责令改正,会同有关部门视情采取以下措施: (一)禁止或者限制其从事政府采购、招标投标以及有关的货物、技术进出口或者国际服务贸易等活动; (二)禁止或者限制其从境外接收或者向境外提供数据、个人信息; (三)禁止或者限制其出境、在我国境内停留居留; (四)其他必要的措施.
Article 20: Where the Ministry of Commerce deems it necessary, it may adjust the measures adopted in accordance with Articles 17, 18, 19, and other relevant provisions of these Measures. 第二十条 商务部认为必要时可以对依照本办法第十七条、第十八条、第十九条等规定采取的措施进行调整.
Article 21: The Ministry of Commerce is responsible for the interpretation of these Measures. 第二十一条 本办法由商务部负责解释.
Article 22: These Measures shall enter into force as of the date of promulgation. 第二十二条 本办法自公布之日起施行.
In addition to this, also released was an announcement: Matters Concerning Further Improving the Handling of Reports of Violations of Export Controls on Strategic Mineral Dual-Use Items. Sinocism has a full translation.
“China’s Ministry of Commerce made an announcement on Wednesday highlighting steps to further improve the handling of reports on violations in relation to export control of strategic mineral dual-use items. Article 31 of the Export Control Law stipulates that any organization or individual has the right to report suspected violations to national export control authorities, a spokesperson with the ministry said. Further optimizing the handling of reports on such acts concerning strategic mineral dual-use items and enhancing law enforcement capabilities is a fundamental requirement for improving the country’s export control system, as well as a normal measure to safeguard national security and interests, according to the spokesperson. Giving play to the supervisory role of tip-offs regarding export control violations is a common international practice, with relevant provisions in place in many countries, the spokesperson noted. Drawing on international experience to improve China’s reporting system for export control of strategic mineral dual-use items can effectively prevent relevant items from being used for illegal purposes, better safeguard world peace, and demonstrate China’s sense of responsibility as a major country, the spokesperson said. Relevant practices concerning report handling have been rolled out previously, and it is necessary to further clarify reporting methods, content and other details to better handle related clues, the spokesperson added.”
The announcement says that the aim is to “give full play to the role of social oversight and to crack down on violations of export controls on strategic mineral dual-use items”. Among other things, people can also report anyone:
“unlawfully transferring controlled strategic-mineral-related technology abroad by means such as trade exports and intellectual-property licensing, investment, exchange, gifting, exhibition, display, inspection, testing, assistance, instruction, joint R&D, being employed or employing, and consulting;”
“knowingly providing services such as agency, freight, dispatch, customs declaration, third-party e-commerce trading platforms, and finance to an export operator engaged in unlawful conduct in the export of strategic mineral dual-use items…”
